Atlas Alert — Terms and Conditions

Welcome to Atlas Alert. Before you create your account, please read this agreement carefully. By tapping "I Agree" and creating an account, you accept everything described below. If you do not agree, please do not use Atlas Alert.

WHAT ATLAS ALERT DOES

Atlas Alert is a monitoring service. We use cameras you install at your barn together with artificial intelligence to watch your horse around the clock. We track patterns such as drinking, eating, lying down, posture, manure levels, hay availability, water availability, and other behaviors. When we see something unusual, we send you notifications so you can check on your horse faster than you otherwise would.

Atlas Alert is a tool that helps you watch your horse. It is not a veterinarian and it is not a diagnostic device.

YOU REMAIN RESPONSIBLE FOR YOUR HORSE

Atlas Alert acts as a second pair of eyes over the stall. Our promise is simple: what the camera can clearly see, we can detect. For this reason, correct installation is the foundation of the service. If the camera is poorly positioned, obstructed, badly aimed, or does not cover the relevant areas of the stall (water buckets, feeders, resting areas), we cannot detect what we cannot see. Your commitment is to ensure that the angle, height, lighting, and connectivity of your camera follow the installation guidelines we provide at the time of purchase. If you install correctly, Atlas Alert does its job.

Even so, Atlas Alert is not a substitute for professional veterinary care or your own direct attention. If your horse appears to be in distress, you must contact a licensed veterinarian immediately. Do not wait for Atlas Alert to tell you something is wrong. Ultimate responsibility for your horse's wellbeing remains with you and your veterinarian, not with Atlas Alert.

HOW WE USE YOUR VIDEO AND DATA

When you connect a camera, video from that camera is sent to our servers, where our AI analyzes it in real time. We may save still images from the video as evidence when our AI detects an event (for example, a drinking session, a feeding, or an anomaly). We retain these images for a limited period so you can review them in the app. We do not record or stream your live video to anyone outside your account.

We will never sell your video. We will never share your video with advertisers, insurance companies (without your separate written consent), or any third party for marketing purposes. We share information only when (a) you tell us to, (b) the law requires us to, or (c) it is needed to deliver the service through our contracted infrastructure, notification, and messaging providers.

USE OF YOUR FOOTAGE TO IMPROVE THE AI

To make Atlas Alert smarter and more accurate for every customer, we use frames from your cameras to train and improve our AI models. We only use frames that have been reviewed and stripped of anything that could identify you or anyone else, such as faces, license plates, names, or specific locations. We use only material related to horses, stalls, hay, water, manure, and similar non-personal content.

This contribution to AI improvement is a fundamental part of the service and is not optional. By accepting these terms, you authorize Atlas Alert to use anonymized frames from your cameras for model training. This process benefits you directly, because the AI you rely on improves over time: better early detection of colic, more accurate feeding tracking, and fewer false alerts for every customer, including you. If at any point you prefer not to participate in this contribution, you must cancel your subscription.

PEOPLE WHO MAY APPEAR IN YOUR VIDEO

Our cameras are aimed at your horse and the stall, not at people, but employees, family members, farriers, vets, and visitors may occasionally appear in the frame. You are responsible for letting anyone who works in or visits the monitored area know that the area is being recorded, wherever your local laws require it. Atlas Alert is the technology provider; you are the party doing the recording.

CAMERAS, INSTALLATION, AND PRIVACY

You confirm that you own the property where the cameras will be installed, or that you have permission from the property owner to install and operate them. If you board your horse at a stable, you confirm that you have arranged with the stable owner to install cameras. You agree not to point cameras at neighboring property, public areas, or anywhere people would reasonably expect privacy. You are responsible for following all applicable surveillance and recording laws in your state and locality.

If a third party complains about being recorded, that matter is between you and them. You agree to defend us and hold us harmless against any claim that camera placement violated someone else's privacy.

ALERTS

By creating an account, you authorize Atlas Alert to send you push notifications, email, SMS messages, and (when available) phone calls when our system detects an event involving your horse. You can configure quiet hours and other preferences in your profile. Critical safety alerts will always be delivered, even during quiet hours, because the cost of suppressing them could be your horse's life.

We deliver these alerts using the notification, messaging, and telephony providers we have under contract, which we may change at any time without prior notice. Carrier rates and limits may apply. We have no control over your cellular signal, your internet, or whether your phone is reachable at any given moment.

SMS TEXT-MESSAGE ALERTS (US CUSTOMERS)

SMS text-message alerts are one of the notification channels Atlas Alert offers, in addition to push notifications, email, and phone calls. SMS is entirely optional. You are not required to enable SMS to use Atlas Alert, and you can turn SMS off at any time without losing access to the rest of the service.

To enable SMS alerts you must, inside the Atlas Alert mobile app, open the profile of a specific horse, open "Escalation order", enter a valid mobile phone number as primary or secondary contact for that horse, and turn the SMS toggle ON. By turning the toggle ON, you expressly consent to receive automated text messages from Atlas Alert about that horse at the number you provided, sent using an automatic telephone dialing system or similar technology.

Message frequency varies with activity at your barn and with the alert preferences you configure. In normal operation you typically receive fewer than five (5) SMS messages per horse per month. During an active health or safety incident you may receive more messages until you acknowledge the alert in the app or until the situation is resolved. Message and data rates from your mobile carrier may apply. Atlas Alert does not charge you for SMS delivery.

SMS alerts are transactional health and safety notifications only. We do not send marketing, promotional, or advertising content over SMS.

You may stop receiving SMS alerts at any time by any of the following methods: (a) reply STOP to any Atlas Alert SMS message; (b) inside the app, open the horse profile, open "Escalation order", and turn the SMS toggle OFF; or (c) contact us at info@atlasalert.ai and ask us to remove the number. You may reply HELP to any Atlas Alert SMS message to receive assistance, or contact info@atlasalert.ai. After a STOP reply, no further SMS messages will be sent to that number unless you opt back in through the app.

Consent to receive SMS alerts is not a condition of purchasing or using Atlas Alert. Standard-rate carriers currently supported include AT&T, Verizon, T-Mobile, and other US carriers; delivery is not guaranteed on any specific carrier. Atlas Alert is not liable for delayed or undelivered SMS caused by your mobile carrier, your device, your location, or any circumstance outside our reasonable control.

Consent and data sharing. By turning on the SMS toggle inside the Atlas Alert mobile app, you give consent directly to Atlas Alert (and only to Atlas Alert) to send you automated text-message alerts. Your mobile phone number and SMS opt-in data will not be shared with any third parties or affiliates for their marketing or promotional purposes. Phone numbers you provide for SMS alerts are used solely for delivering the alerts you have requested. We do not sell, rent, share, disclose, or otherwise transfer mobile phone numbers or SMS opt-in information to third parties or affiliates for their marketing purposes. Phone numbers are shared only with the messaging carriers we contract with to deliver the SMS, and only for the purpose of that delivery. ACCOUNTS, SUBSCRIPTIONS, AND BILLING

Atlas Alert AI monitoring requires an active subscription. If your subscription lapses, monitoring and alerts stop. Camera hardware is sold separately. Specific subscription terms, renewal rules, and refund policies are described in our Subscription Policy and Refund Policy, available on our website.

You are responsible for keeping your account credentials secure. You may not share your personal password. If you choose to invite other people to view your video or your alerts, you must do so through the official shared-access features provided in the app, not by sharing credentials.

CAMERA OWNERSHIP AND USE

The Atlas Alert cameras you purchase are your exclusive property as the buyer and are linked to your personal account. Your purchase grants you a personal license to use the hardware with the Atlas Alert service.

As the account holder, you may share access to your video and your alerts with other people designated by you (family members, employees, veterinarians, persons in charge of caring for the horse) through the official shared-access features in the app. The persons with whom you share access remain under your responsibility, and you retain at all times the ownership and control of both the account and the camera. You may revoke shared access at any time.

However, the camera as a physical device is not authorized to be resold, transferred in ownership to third parties, lent for use under another account, or distributed through unofficial channels. Any secondary sale, transfer of ownership without our prior written consent, or any attempt to circumvent the official acquisition system — including grey market sales, parallel sales, "under the table" sales, unauthorized auctions, or resale through third-party platforms — constitutes a material and immediate breach of these terms.

The consequences of such a breach include, without limitation: the immediate and permanent voiding of the hardware warranty; the immediate termination of the service associated with that camera without compensation; the unbinding of the camera from the original buyer's account; and our reserved right to initiate legal action under applicable federal and state laws, including civil claims for damages, lost profits, and breach of contract.

Each Atlas Alert camera has a unique hardware identifier digitally bound to your buyer account from the moment of activation. Our systems detect any attempt to register, activate, or connect that camera to an account different from the original buyer's. In such cases, service will be denied automatically and without exception, until the original buyer formally authorizes the transfer through Atlas Alert's official process, which remains entirely at the company's discretion.

DATA RETENTION

We retain account, billing, and personal information for as long as your account is active. After cancellation, we keep limited information needed for billing reconciliation, fraud prevention, and legal compliance for up to thirty days. Evidence frames are retained for approximately thirty days for routine events and approximately ninety days for anomaly events. Anonymized AI training data may be retained indefinitely. You may request export or deletion of your personal data by contacting support.

LIMITS ON OUR LIABILITY

Atlas Alert is provided on an as-is, as-available basis. We make no warranty that the service will be uninterrupted, error-free, accurate, complete, or fit for any particular purpose. We are not liable for losses, damages, injuries, or any other consequences arising from missed alerts, false alerts, delayed alerts, service downtime, hardware failures, network failures, or anything outside our reasonable control.

To the maximum extent permitted by law, our total liability to you for any claim related to Atlas Alert is limited to the greater of five hundred dollars (US$500.00) or the total amount you paid us during the twelve months immediately before the event giving rise to the claim. This limit applies regardless of the legal theory and regardless of whether we were warned of the possibility of such damages.

YOUR INDEMNIFICATION OF US

You agree to defend, indemnify, and hold harmless Atlas Alert, its officers, employees, contractors, and affiliates, against any third-party claim, demand, loss, or expense (including reasonable attorney fees) arising from your use of the service, your camera placement, your sharing of access with others, your failure to follow these terms, or your violation of any applicable law.

GOVERNING LAW AND DISPUTE RESOLUTION

This agreement is governed by the laws of the State of Arizona, United States of America. Any dispute relating to Atlas Alert that cannot be resolved informally will be settled by binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association, except where prohibited by law. You waive any right to a jury trial and to participate in any class, collective, or representative action against us.

CHANGES TO THESE TERMS

We may update these terms from time to time. If we make material changes, we will tell you in the app and ask you to accept the updated version before continuing to use Atlas Alert.
